Description

In The Surveyor's Judicial Role series of tutorials, we propose a broader role that the professional surveyor should arguably take in helping property owners avoid the expense and angst of unnecessarily litigating boundaries when there has been acquiescence to an accepted line by both owners. In this third tutorial, we explore title insurance: what it is, what it is not, what it provides, how it differs from other types of insurance and why anyone buying or owning property should have it.

Upon completion of this course, the participant should expect to be able to:
• Outline the role of title insurance in the U.S. land tenure system
• Identify the two types of protection afforded by title insurance
• Explain the relationship between the standard survey exception in a title commitment/policy and the ALTA/ACSM Land Title Survey
• Describe the types of claims that title companies incur
• Explain the process, advantages and disadvantages of title registration

Gary Kent is in his 31st year with The Schneider Corporation, a surveying, GIS and consulting engineering firm based in Indianapolis and with offices in Charlotte, North Carolina and Ankeny, Iowa. He is chair of the NSPS committee on the ALTA/ACSM Standards and is liaison to NSPS for the American Land Title Association. Gary is often called as an expert witness and he regularly presents programs across the country on a variety of topics including boundaries, survey standards and easements. He is a past-president of both ACSM and the Indiana Society of Professional Land Surveyors. Gary taught Boundary Law, Legal Descriptions, Property Surveying and Land Survey Systems as an adjunct instructor for Indiana University-Purdue University in Indianapolis from 1999 to 2006 and in West Lafayette in 2006. He received Excellence in Teaching and Outstanding Associate Faculty awards for his work at IUPUI. Gary has served on Indiana State Board of Registration for Professional Surveyors for 10 years. He writes regular columns for The American Surveyor magazine and for NSPS News and Views.
