Description

Now that same-sex marriage is legal in California, and federally recognized, the spread of legal divorce is transforming the nature of lesbian and gay breaks-ups. Couples are enmeshed in the judicial dissolution process, facing the implications of laws that often are seen as incongruent with their sense of identity. Mediators who work in this field need to understand the changing laws and develop communication skills that are effective for this diverse community.
This program will review the recent legal changes, explain the impacts on same-sex couples, highlight the special concerns of non-traditional families and transgendered parties, and provide guidance to help mediators learn how to be effective in this arena.

A graduate of Berkeley School of Law, Frederick Hertz practices real estate and non-traditional family law and mediation in Oakland. His practice is focused on the formation of property co-ownership and premarital agreements, and the resolution of property and financial disputes between families, spouses and domestic partners, business partners, friends, and unmarried couples, both same-sex and opposite-sex. Mr. Hertz writes and speaks nationally on the impact recent legal changes have on same-sex couples. His is the author of Legal Affairs: Essential Advice for SameSex Couples (Henry Holt & Co./Owl Books), Making It Legal: A Guide to Same-Sex Marriage, Domestic Partnerships & Civil Unions (Nolo Press), and co-author of Legal Guide for Lesbian and Gay Couples Living Together (Nolo Press).
