Description

Only two persons who can truly resolve a disputed boundary or title problem. Those persons do not include attorneys, title companies or surveyors. And, in a sense, they do not even include judges and juries - at least not of their own volition. In this series of tutorials, we will explore the role that the professional surveyor can and arguably should take in helping property owners establish or maintain their common boundary at the location that they were perfectly satisfied with - at least until the surveyor showed up! In this second tutorial we look at considerations in the dynamic that exists between matters of title and matters of survey.

Upon completion of this course, the participant should expect to be able to:
• Explain the role and authority of the surveyor with respect to unwritten rights
• Explain the surveyor's responsibility with respect to junior/senior conflicts
• Identify the three different types of recordation acts.
• Outline the differences between the three different types of recordation acts
• Describe the purpose of a marketable title act and how it operates

Gary Kent is in his 31st year with The Schneider Corporation, a surveying, GIS and consulting engineering firm based in Indianapolis and with offices in Charlotte, North Carolina and Ankeny, Iowa. He is chair of the NSPS committee on the ALTA/ACSM Standards and is liaison to NSPS for the American Land Title Association. Gary is often called as an expert witness and he regularly presents programs across the country on a variety of topics including boundaries, survey standards and easements. He is a past-president of both ACSM and the Indiana Society of Professional Land Surveyors. Gary taught Boundary Law, Legal Descriptions, Property Surveying and Land Survey Systems as an adjunct instructor for Indiana University-Purdue University in Indianapolis from 1999 to 2006 and in West Lafayette in 2006. He received Excellence in Teaching and Outstanding Associate Faculty awards for his work at IUPUI. Gary has served on Indiana State Board of Registration for Professional Surveyors for 10 years. He writes regular columns for The American Surveyor magazine and for NSPS News and Views.
